Can Florida law firms record client calls?

Florida law firms can record client calls — but the legal and ethical constraints are stricter than most lawyers realize. (1) Florida is a two-party (all-party) consent state under Fla. Stat. 934.03. Recording a phone call without the consent of every party is a third-degree felony. The standard compliance path is an automated greeting at the start of every call ("This call may be recorded for quality and case-management purposes"), which provides notice; recording without that notice is the violation. (2) Florida Bar Rule 4-1.6 (confidentiality) extends to call recordings — a recording of a client conversation is protected client information and the firm must implement reasonable safeguards (encryption at rest, access controls, audit logging of who accessed recordings) under Comment 16 to Rule 4-1.6. (3) Attorney-client privilege is preserved if the recording is made in the course of representation, not disclosed to third parties, and stored securely. Inadvertent disclosure of a recording to a third party can waive privilege. (4) Retention: there's no Florida Bar rule mandating retention period for call recordings, but most firms align with the matter file retention policy (typically 5-7 years post-case-close, longer for estate planning and minors).
